Terms of Service

1. Parties and scope

These terms apply between Finn Thorwarth, Westerstraße 93, 28199 Bremen, Germany ("Provider") and you as the user ("you") of the Garage mobile application for iOS and Android.

2. Service description

Garage is an app to manage vehicles, maintenance, repairs and costs. It is offered as a free base version (limited to one vehicle) and a paid premium version. Premium is available as a subscription (monthly or yearly) or as a one-time lifetime purchase.

3. Conclusion of contract

By creating an account in the app, you enter into a contract with the Provider for the use of base features. By purchasing a subscription via the respective app store, an additional contract for premium features is concluded. Payment is processed via your Apple or Google account.

4. Term, trial period and cancellation

Subscriptions renew automatically for the chosen period unless cancelled at least 24 hours before the end of the period. You can manage and cancel subscriptions in your App Store / Google Play account settings.

If a free trial (currently 7 days) is offered, it automatically converts into the chosen paid subscription unless cancelled before it ends.

The lifetime purchase is a one-time payment, does not renew and requires no cancellation.

5. Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The period starts on the day the contract is concluded.

To exercise the right of withdrawal, send us an unambiguous statement (e.g. by email to support@garage-management.com). For purchases made via the App Store or Google Play you can additionally request a refund directly from Apple or Google.

Loss of the right of withdrawal: Pursuant to § 356 (5) BGB, the right of withdrawal expires for contracts on the supply of digital content not on a tangible medium when the Provider has begun performance, after you have

  1. expressly consented to performance starting before the end of the withdrawal period, and
  2. acknowledged that this consent causes the right of withdrawal to expire.

You give this consent when you purchase a premium subscription in the app.

6. Liability

The Provider is liable in accordance with statutory provisions for damages from injury to life, body or health, intentional acts and gross negligence, and under the German Product Liability Act. Otherwise, liability is limited to the typical, foreseeable damage.

7. Availability

The Provider strives for high availability of the online features but does not guarantee uninterrupted availability. Maintenance windows and temporary outages may occur.

8. Changes

The Provider may change these terms when necessary for legal, technical or organisational reasons. Changes will be communicated in good time, e.g. inside the app, before they take effect.

9. Governing law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with their habitual residence in the EU, the mandatory consumer-protection rules of their country of residence remain unaffected.
